Privacy Policy
Last updated: October 11, 2026
Your privacy matters to us. This policy explains what information we collect when you use Simcha SMS, why we collect it, how we protect it, who we share it with, and the choices and rights you have.
1. Who we are
Simcha SMS ("we", "us", "our") operates simchasms.com and designer.simchasms.com, where customers personalize and buy downloadable Jewish simcha invitations in Hebrew and English, and invited designers create and sell designs.
For any privacy question or request, contact us at sales@simchasms.com.
2. Information we collect
Information you give us:
- Account details: name, email address and password (passwords are stored only in encrypted, hashed form).
- Invitation wording you enter: names, dates, places and other event details you type into a design.
- Order details: the design, paper size, file format (PDF or PNG), price and order number.
- Messages and attachments you send us through Need help, chats or email, including pictures, files and voice notes.
- Mobile phone number, if you choose to give it to receive text messages (see our Text Messaging Policy).
- Designers: application details, portfolio artwork, uploaded fonts, payout information and tax details we need to pay you.
Information collected automatically: device and browser type, IP address, pages viewed, approximate location derived from IP, and technical logs used to keep the site secure and working. We use only cookies and local storage that are needed for sign-in, saving your drafts and preferences, and basic site operation.
Information from others: our payment processor tells us whether a payment succeeded; it does not give us your full card number.
3. How we use your information
- To create your invitation files and deliver your paid downloads.
- To create and secure your account and let you sign in.
- To process payments, prevent fraud and keep business and tax records.
- To answer your questions and provide customer support.
- To send order confirmations and other service messages by email, and by text only if you opted in.
- To review designer applications, publish approved designs and pay designers.
- To improve the website, fix problems and protect against abuse.
- To meet legal obligations.
4. Payments
Payments are handled by a secure, PCI-DSS compliant third-party payment processor. Your card number, expiry date and security code go directly to that processor; we never see or store your full card details.
We keep a record of each order (order number, items, amount, date, payment status and the email used) to provide your downloads, handle questions and refunds, and meet accounting and tax rules. Designers' payout information is used only to pay them and is visible only to authorized staff.
6. Text messaging
If you choose to receive text messages from us, how opt-in works, message frequency, the STOP, HELP and START keywords, and how your phone number is protected are explained in full in our Text Messaging Policy, which is part of this Privacy Policy.
7. How long we keep information
- Account information: while your account is open, and deleted or anonymized after you ask us to close it, unless we must keep it by law.
- Orders and payment records: as long as required for tax and accounting (generally up to 7 years).
- Unfinished drafts: until you delete them or close your account.
- Messages and support chats: as long as needed to help you, then deleted on request.
- Text message opt-in and opt-out records: kept as proof of your choice, as required by phone carriers.
8. How we protect information
We use encrypted connections (HTTPS), hashed passwords, access controls so staff see only what their role requires, database-level protections, and watermarking of previews. No system is perfectly secure, but we work to protect your information and will notify you as required by law if a breach affects you.
9. Your privacy rights
Depending on where you live (including under U.S. state laws such as California's CCPA/CPRA, and the EU/UK GDPR), you may have the right to:
- Know and access the personal information we hold about you.
- Correct inaccurate information.
- Delete your information.
- Receive a copy of your information in a portable format.
- Object to or limit certain uses, and withdraw consent at any time.
- Opt out of the sale or sharing of personal information — we do not sell or share it.
- Not be treated differently for using these rights.
To make a request, email sales@simchasms.com. We may need to confirm your identity and will reply within 30 days (45 days where the law allows). EU/UK residents may also complain to their local data protection authority. Where GDPR applies, we rely on performing our contract with you, your consent, our legitimate interests in running and securing the service, and legal obligations.
10. Children
Our website is not directed to children under 13 (or 16 where local law requires), and we do not knowingly collect their personal information. Invitations may name children, such as for a bris, upsheren or bar mitzva; this wording is used only to create the invitation you ordered. If you believe a child gave us information, contact us and we will delete it.
11. International users
We are based in the United States, and your information may be processed there. When information moves across borders, we use appropriate safeguards required by law.
12. Do Not Track and cookies
We do not use advertising or cross-site tracking cookies, so there is nothing to opt out of. You can clear cookies and local storage in your browser at any time; doing so may sign you out and remove locally saved drafts.
13. Changes to this policy
We may update this policy. The "Last updated" date at the top will change, and for important changes we will notify you by email or on the website.
